Collection and consent statement - healthcare practitioners

  1. The services and/or products provided by Mindset Health Pty Ltd ABN 11 617 368 957 (Mindset, we, us, or our) include digital hypnotherapy programs for irritable bowel syndrome (Nerva), menopause (Evia), smoking cessation (Finito), mental health (Claria), and chronic low-back pain (Relio).
  2. In handling your personal information, Mindset complies with the Privacy Act 1988 (Cth) and all other relevant Australian privacy and health records laws.
  3. All collection, use, disclosure and storage of your personal information by Mindset will be for the primary purposes set out in our Privacy Policy which can be accessed https://www.mindsethealth.com/legal/nerva-privacy-policy including:
    1. providing our services and products to you and patients that you refer to us;
    2. communicating with you and responding to any inquiries you may have regarding our services and products;
    3. providing educational marketing material about our products;
    4. notifying you about changes to our services and products; and
    5. processing and dealing with any complaints or enquiries made by you.
  4.  We may also collect, use and disclose your personal information for related secondary purposes as set out in our Privacy Policy, including for:
    1. billing, administration and quality assurance;  
    2. research, development, benchmarking, and improving our services and products; and
    3. compliance and protection, including to enforceany applicable terms and conditions, comply with legal obligations, defend against legal claims or disputes, protect the security and integrity of our services and products, and identify and investigate fraudulent, harmful, unauthorized, unethical or illegal activity.
  5. Mindset may collect your personal information directly from you.  However sometimes wemay need to collect it from a third party where you have consented or where it is not reasonable or practical for us to collect your personal information directly from you.
  6. We may disclose your personal information in accordance with our Privacy Policy including to third party service providers, advertising partners, professional advisors and regulatory bodies and otherwise with your consent.
  7. Mindset stores all personal information on a secure database.  Mindset may store personal information on servers located outside of Australia.
  8. Generally, you have the right to access your personal information.  You can also request we amend personal information that we hold about you if you believe that it is inaccurate.  All access and correction requests will be managed in accordance with Mindset’s Privacy Policy.

  10. If you do not consent to the collection of your personal information, we may be unable to provide our services and/or products to you and/or patients that you refer.
